These are pedestrians?
Many road users consider the electric scooter rider to be nothing more than a pedestrian. And this is, given that modern devices can accelerate to 60 km / h or more. Even cyclists who travel much slower are not pedestrians.
But traffic rules in our case have a clear definition here. According to him, a pedestrian is a person who is outside the vehicle. It also indicates that people who use scooters or other similar means for movement are equated with pedestrians.
Here we need to figure out 2 questions to answer:
- Is an electric scooter equal to a vehicle by definition of traffic rules?,
- whether it refers to “other similar means” according to the official text of the Rules?
To answer them, we go to the definition of a vehicle and see that this is a device that is designed to transport people along the road. Please note that the road also includes sidewalks and shoulders.
Let’s go even further and look at the definition of a power-driven vehicle. it is driven by an engine.
Thus, an electric scooter is essentially a vehicle under the traffic rules of 2021. However, there is no direct reference to this in the Rules, since it is not stated directly to what this category is equated with.
Do I need rights?
Just depending on the characteristics of your electric scooter, we find out in what cases a driver’s license is required. And we have only 2 options here:
- if the electric scooter has a power of less than 250 W, then the rights to it will not be required,
- if it exceeds at least one of the values, then you will need a license to drive a moped. according to the Federal Law On Road Safety, any category of a car (or motorcycle) driver’s license confirms the right to drive such an electric scooter.
The third option is when your electric scooter has a maximum design speed of more than 50 km / h. By definition, this is no longer a moped, but a motorcycle. But there has not been any judicial practice in such cases yet. Almost always, the courts equate such a device with mopeds.
Thus, to ride an electric scooter with a power of more than 250 watts, you need a driver’s license of any category.
Where can I go?
For devices less than 250 W, that is, for pedestrians:
- electric scooters must move along sidewalks, pedestrian or bicycle paths,
- if the above is not on this site, then on the side of the road,
- if there is no roadside, then along the edge of the carriageway towards the flow of cars.
- on the road along the right edge of the carriageway or along the lane for cyclists,
- as well as on the side of the road, provided that there is no interference with pedestrians.
Please note that on an electric scooter with a capacity of more than 250 watts, it is prohibited to ride on sidewalks, as well as on pedestrian paths and bike paths, according to traffic rules.
Is it possible to drive drunk and without a license?
Everything is the same here, depending on the power:
- you can ride an electric scooter with a power of up to 250 W while intoxicated, including alcoholic or narcotic,
- but driving this device while drunk, if its power exceeds the value, is prohibited and will lead to the deprivation of a driver’s license for a period of 1.5 to 2 years and a fine of 30,000 rubles under Part 1 of Article 12.8.
The same is the case with driving without the right to drive (if you have never received a driver’s license in your life), being deprived or not having a car with you. It is forbidden to drive an electric scooter that has an engine of more than 250 watts.
A strange situation occurs when you rent a device while drunk. In this case, you must also attract the one who handed it over to you under Part 2 of this article for transferring control to a person in a state of intoxication.
What other requirements?
There are additional regulations and prohibitions, among others, which are governed by section 24 of the Moped Regulations. that is, for devices over 250 watts. Among them:
- it is forbidden to ride an electric scooter without hands (you can use one hand on the steering wheel),
- you cannot carry passengers (for single devices),
- it is also prohibited to transport a child under the age of 7 years,
- on such an electric scooter, you must wear a helmet, and it must be fastened,
- dismount before the pedestrian crossing,
- it is forbidden to tow another electric scooter.
In addition, the current traffic rules recommend that when driving in the dark, wear reflective vests or have other such items and ensure their visibility to other road users.
Almost all decisions of the courts on the question of whether it is possible to drive an electric scooter drunk are similar and follow the algorithm described above, depending on the power of the motor.
Here is an example of the most standard court decision, where the operator of an electric scooter was found guilty of drunk driving and was sentenced under Part 1 of Article 12.8 of the Administrative Code to deprivation of rights and a fine of 30,000 rubles. All arguments from the driver that this is not a vehicle were rejected by the judges of both instances, because the device’s documentation indicated a power of more than 250 watts.
What electric scooters are equated with in practice?
Traffic police officers have recently often stopped such devices. And they write out fines and even deprive a driver’s license for driving them. This gave impetus to certain well-established jurisprudence.
In 2021, this practice is as follows:
- if you drive an electric scooter with a motor power of no more than 250 watts, then you are equated with a pedestrian,
- riding an electric scooter with a power that exceeds the specified value creates a situation when traffic police officers and courts consider it a moped.
But here this state of affairs is somewhat contrary to traffic rules. The fact is that most electric scooters have a power of more than 250 W, but their speed is often over 50 km / h. But in judicial practice, even if the speed exceeds its value of 50 km / h, it is still a moped, not a motorcycle.
Please note that traffic rules are governed by the definition of “rated maximum power in continuous operation”. If you look at the characteristics of your electric scooter, then most often it will simply indicate the maximum power (it is also called peak power). And in the continuous load mode, as a rule, its value is slightly lower.
The attitude of electric scooters to mopeds was also directly explained in the official response of the traffic police.
Is it legal to transport bicycles on a tow bar
Every car enthusiast had to transport a bicycle by car at least once in his life. There are several ways to position your bike, each with its own merits and demerits. Let’s take a closer look at them and talk about whether it is legal to mount a bicycle on a towbar.
How can you transport a bicycle in a car
Transportation in the trunk or cabin. The disadvantages of this method of placement include the need for partial disassembly of the bike, a high probability of staining and / or damage to the car’s lining, discomfort during loading, the ability to load no more than two bicycles into one car, and the fact that the bike takes up the space reserved for passengers or luggage. The advantage of this method is that there is no need for expensive fasteners.
Transporting the bike on the roof. This option is also not without its drawbacks. The bicycle gets dirty during such transportation. Loading is inconvenient, especially in cases where the roof is high and the car owner is short. If the bike is not properly loaded or is not properly secured, the roof can be damaged. This option also makes it possible to transport two or three bicycles without sacrificing space in the cabin. But it is transportation on a towbar that causes the most controversy from the point of view of legislation. After all, in this case, bicycles obstruct numbers and light signals.
Offenses when transporting on a tow bar
We will assume that installing a bike rack is not a design change. That is, the driver uses the mount with the necessary papers: a certificate of conformity and documentary evidence that the mount is universal or suitable for this car model.

Is it punishable to outweigh the number on the mount
Often there are bike racks that have room for a number. It is assumed that the owner of the car will outweigh the number there. However, is it as harmless as it might seem at first glance? We are considering paragraph 2 of the main provisions on the admission of the vehicle to operation duties of officials to ensure road safety.
On motor vehicles (except for mopeds, trams and trolleybuses) and trailers, registration plates of the appropriate sample must be installed in the places provided for this, and on cars and buses, in addition, a license card is placed in the lower right corner of the windshield in established cases.

There is also a completely “extreme” case: when you need to fly somewhere with your bike. All airlines classify such baggage as oversized cargo. It can be transported free of charge only if the weight restrictions set by the carrier are observed. Pack your bike separately from other items. Transportation methods are conventionally divided into 2 categories: humane and inhumane. The former are usually only applicable in relatively empty wagons. The latter, on the other hand, are inconvenient for bikers, can cause discontent among passengers or lead to damage to the bike. To increase convenience, each participant is advised to have an elastic band with steel hooks and rubber rings (from the old camera) worn on the grips (work like parking brakes).
 Hanging bicycles
One of the most common transportation methods. The bike is attached by the saddle to the luggage rack, on each rack (preferably at the end of the car) there are 3-4 bicycles in normal mode, the load is folded under them. Option: 2-3 bicycles are hung up, bikers sit under them.
Despite the seeming unreliability of the method, there are no special problems with high-quality fastening of the rear wheels with expanders. Poorly fastened bikes can collapse in unison, but this does not lead to fatal consequences. The risk of falling bikes is almost zero.
Luggage racks are saddle-friendly (with longitudinal bars) and unfriendly (all others). The latter are theoretically not as reliable and can damage the saddle lining. A bike with a Brooks saddle must not be hung at all.
Bicycles with horns have a big advantage. they do not tend to fall sideways at the first opportunity or crush the equipment on the handlebars with their weight. Such a bike can be hung one at a time even in the compartment where 6 passengers sit (if you are lucky, then there will be no discontent).
- You can hang almost any number of bikes in almost any wagon.
- Dirt from bicycles (especially in winter).
- It is long and physically difficult to hang up and take off.
